My 1099 Came Late (or Never) and They Won’t Answer: What to Do When You’re Self-Employed

You never received the 1099, and the person who owes it to you won’t answer. The short answer: a missing form doesn’t change what you owe or what you report. You report the income from your own records, file on time, and fix the paperwork later if the form ever turns up.

Rule #1: the income counts either way

Self-employment income is taxable whether or not a 1099 arrives. A 1099 is just an information return the payer sends you and the IRS. If it’s missing, you still report the income on Schedule C using your own records. Here’s what goes on each Schedule C line.

The form isn’t always required, either. For payments made through 2025, a payer only has to send a 1099-NEC once they’ve paid you $600 in the year; for payments made in 2026 that threshold rises to $2,000. Below it there’s no form, but the income is still taxable.

Case 1: It’s late and you haven’t filed yet

  • Payers have until January 31 to send 1099-NEC forms. Nothing by mid-February means it’s late.
  • Check the spam folder, the payer’s online portal, the payment app you were paid through, and your old mailing address.
  • Ask in writing (email or portal message) and keep a copy. It shows a good-faith effort.
  • Still nothing by the end of February? The IRS can contact the payer for you at 800-829-1040. Have the payer’s name, address and your estimate of the amount ready.

Case 2: You never got it and can’t reach the payer

Don’t hold your return hostage. Rebuild the number from:

  • Bank deposits from that client
  • Invoices you sent and the payments that matched them
  • Payment-app history and any 1099-K from a platform
  • Texts or emails confirming amounts paid

Report the income from those records and keep them in a folder with your return. If a form arrives later with a different number, your records show which is right.

Case 3: The 1099 shows up after you filed

The “I filed, and this month the 1099 showed up, I guess it was lost in the mail” situation:

  1. Compare it to what you reported. Same income, same amount? Save the form; you’re done.
  2. Income you left out, or a different amount? File an amended return on Form 1040-X. Recent years can be amended electronically.
  3. The form itself is wrong (amount, person or year)? Ask the payer for a corrected 1099 in writing. If they won’t, keep your proof and report what’s true.

Amending is routine, and far better than the IRS noticing a mismatch first.

Case 4: Should you have gotten a W-2 instead?

A missing 1099 sometimes hides a bigger question. If the payer controlled your schedule, tools and methods, you may have been misclassified. Our post on W-2 vs 1099 misclassification explains Forms 8919 and SS-8. If you were an employee and never got a W-2, see what to do with Form 4852.

Owe more than you can pay?

Report it correctly and file on time anyway. Filing stops the 5%-a-month late-filing penalty, and most balances under $50,000 can go on a payment plan. If you’re already behind, our post on catching up on unpaid estimated taxes walks through it.

This is why Toozi exists

A late 1099 is annoying but survivable if you know what you earned. Toozi keeps a running record of your income as it comes in, by text, so you never depend on a client’s paperwork. When tax time comes, you see your own numbers and ask for what’s missing.

Set up next January now

  1. Keep an income log all year: who paid you, how much, when.
  2. In early January, email every client: “Please send my 1099 and confirm my mailing address.”
  3. Save payment-app year-end forms.
  4. Compare each 1099 to your log before you file.

Questions people ask

Do I have to report income if I never got a 1099?

Yes. Self-employment income is taxable whether or not a 1099 arrives. Report it on Schedule C from your own records: bank deposits, invoices and payment-app history.

When are 1099-NEC forms due?

Payers must send 1099-NEC forms by January 31. For payments made through 2025 the threshold is $600 per payee; for payments made in 2026 it rises to $2,000. Below the threshold no form is required, but the income is still taxable.

What if a 1099 shows up after I filed?

If you already reported that income at the same amount, keep the form with your records. If it shows income you left out, file an amended return on Form 1040-X. If the form is wrong, ask the payer for a corrected one in writing.
